Hogan's US bank accounts to be examined

Hogan's US bank accounts to be examined

Paul Hogan has lost his bid in the United States to prevent Australian and US tax officials examining his American bank accounts.

US District Court Judge George King, in announcing his decision, described Hogan's lawyers' arguments for keeping the accounts off limits to tax investigators as "meritless" and "misplaced".

The Australian actor's three US banks must produce his "books, records, papers and other data" within 30 days.

Hogan's US legal team had asked Judge King to quash summonses issued by America's Internal Revenue Service, on the behalf of Australian tax officials, to probe his US bank accounts.

"Motion to quash is denied, and the government's motion for an order enforcing the summonses is granted," Judge King wrote in his decision.

It is the latest blow for the Crocodile Dundee star in his battle with Australian tax investigators.

In Australia last week, a federal court judge also ruled against Hogan's attempt to keep documents secret that detail his use of offshore trusts and multi-million-dollar transactions.

In the US case, American prosecutors said Hogan's legal arguments were "unsupported by case authority and without merit" and Judge King agreed.

"Petitioner's argument that the summonses are improper due to potential criminal proceedings in Australia is misplaced," Judge King wrote.

"... The argument that the summonses are contrary to public policy ... is similarly rejected as meritless."

US tax investigators agreed to assist their Australian counterparts to probe the 68-year-old comedian's financial dealings.

Hogan claims he is being unfairly targeted by Australian tax officials and has vowed in numerous interviews with the media to fight the investigation.

Is Paul Hogan above the law? So if I tell a few jokes down the pub and some too many winnie blues will the ATO not look at me.
Bruce (3/09/2008 6:03:54 PM) | Mark As Inappropriate
ken.g, I agree with you. Make the companies taking our money offshore pay their fair share, then we may get a break.

Gary (3/09/2008 5:00:00 PM) |
It would be good to see a projected costing to the taxpaying public for this fishing exercise, and why are the people in the tax office pushing this investigation not personally liable for costs if "Hoges" is found to be in the clear
Brian (3/09/2008 4:56:00 PM) |
Kerry Packer once said "Only an idiot doesn't use his accountant to minimise his taxes!". We don't all have clever accountants. An ordinary taxpayer would have been skinned long ago, no court cases.
John (3/09/2008 4:50:00 PM) |
They say we have a tall poppy syndrome in Australia. The ATO has nothing better to do but waste more tax payers money trying to make an example out of a guythat has probably paid more taxes than any of us. Give it a rest.
Paul (3/09/2008 4:29:00 PM) |
I believe if he has nothing to hide what is the problem. He is no different to any one else and because he is in the limelight and a celeb does he think he should be excused???? Hate the tax man as much as you like - taxes are a part of life.
Carolyn (3/09/2008 4:16:36 PM) | Mark As Inappropriate
People have plenty to hide from the ATO, if you earn income in this country then sure pay your tax. The problem is the ATO want tax from you even when you don't earn income in Aust and live abroad. That is both immoral and unethical!!!!
Joe (3/09/2008 3:59:12 PM) | Mark As Inappropriate
Hoges you are a champion in any country mate. australia is full of nobodies with nothing better to do so we have to keep unemployment down by giving bums a voice , maybe they want u to pay for a train line for northen NSW.

Fred (3/09/2008 1:36:24 PM) | Mark As Inappropriate
Often the innocent pay for the crims but if Hoges is in the clear open the books and prove it, then ATO can apologise if they are wrong.
Len (3/09/2008 1:34:04 PM) | Mark As Inappropriate

andrew (3/09/2008 12:21:46 PM) | Mark As Inappropriate
Everyone should pay tax on money earned; why should Hoges be any different. Some people have the opportunity to hide theirs away...is that fair?
Bob (3/09/2008 11:12:21 AM) | Mark As Inappropriate
Surely it is better to realise NOBODY, no matter how tall a poppy they are is still answerable. If he has done nothing wrong, he has no worries. If he has done wrong why should he be excused.
malcolm (3/09/2008 10:55:58 AM) | Mark As Inappropriate
